1. Terms and Conditions of use
Hello and welcome to Fashion Platform, a social networking site for new and existing designers, models, make-up artists, photographers, manufacturers and many more in the Fashion Industry. The service is operated by Fashion Platform. Please take the time to read and understand the document prior to registering for the Service. By accessing or using the website at www.fashionplatform.com or by posting data, information designs or profiles to be shared, the User signifies that they have read, understood and agreed to act within the criteria of this Terms and Conditions of Use. Therefore you agree to be bound by it. You should be aware that the agreement may change from time to time in accordance with section 2.
2. Changes to this agreement
Fashion Platform reserves the right to change the agreement with its Users at any time, and post new versions on the Fashion Platform website. When we do this it is your responsibility to check on this page for any changes. The Agreement and any amendments take immediate effect. Your continued use of the service or of the Service and/or Site after any such changes constitutes your acceptance of the new Terms and Conditions of Use. If you do not agree to abide by these or any future Terms and Conditions of Use, you agree to not use or access (or continue to use or access) the Service or the Site. It is your responsibility to regularly check the Site to determine if there have been any changes to the Terms and Conditions of Use.

3. Eligibility
Membership in the Service is void where forbidden. This site is intended for Membership of users who are thirteen years of age or over. Any registration by, use of or access to the site by anyone under 13 is unauthorised. Models under the age of thirteen will require registration by their parents who will liaise with the site members or Scouters accordingly. By using the Service or the Site you agree, represent and warrant that you are thirteen or over the age of thirteen and that you agree to the Terms and Conditions of this Agreement. Any persons using the site between the age of thirteen and eighteen should get consent from their legal guardian, becoming Members of Fashion Platform automatically assumes legal guarantors from your legal guardian.
4. Registration Data; Account Security
In provision of your use of the site, you agree to provide accurate, current and complete information about you as required by the registration form on the site, maintain the security of your password and Identification, maintain and promptly update the registration details, and any other information you provide to the Neighbourhood, to keep it accurate, current and complete and to be fully responsible for all use of your account and for any actions that take place using your account.

-You will receive Notifications of Friend requests, a Nudge, as well as any emails from third party, should you opt to receive it in the registration process
-Read the Forum Threads
-Post CVs for recruiters
-Up Load up to 100 photos
-Send, receive and read messages to fellow members and non-members
-Receive emails and Nudges from other users.
-Communicate with fellow members
-Receive Scout badges – with the ability to see the company from which you received a Scout
-Communicate with Industry Professionals
-Read and post messages in the forum
Users are able to use the Fashion Platform site to post CVs via emails in order to get a job in their specific area of choice.

7. Rights in the site content; limited License
All of the site content on the site and available through the service, including but not limited to designs, text, graphics, pictures, videos, information, software, music, sound and any other files and their selection and arrangement are the property of Fashion Platform, its users or its licensors with all rights reserved. No site content can be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any way, shape or form or by any means, in whole or in part, without Fashion Platform’s prior written consent and or permission, except that contained in your own user content (as defined below) that you legally posted on the site.
Providing you have been granted access to use the site, we have granted you – the user a limited licence to access and use the site and the site content and to download or print or copy any portion of the site content to which you have legally gained access solely for your personal, non-commercial use, provided that you keep all Copyright or other notices intact. Except your own user content you may not upload or republish site content or any internet, intranet or extranet site or incorporate the information on any other database or compilation, and any other use of the site is strictly prohibited. Such licence is subject to these Terms and Conditions of Use and does not include any data mining, robots or similar data gathered or extraction methods any other use of the site or the site content other than that specifically detailed and authorised herein.
Unless explicitly stated herein, nothing in these terms and conditions shall be construed as conferring any license to intellectual property rights, whether by estoppels, implication or otherwise. This license can be revoked at any time without notice and with or without cause.
8. Intellectual Property
Fashion Platform, My Fashion Platform, Your Fashion Platform, Nudge, Neighbourhood, My Fashion shop, FP Neighbourhood, and any other company graphics, logos, designs, page headers, button icons, script and service names are the property of The Company. The Company’s trademarks, copyright and other intellectual Property may not be used, including as part of trademarks, and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied imitated or used, in part or in whole without the prior written consent of the company
9. User Conduct
You agree that apart from the advertising programs and the fashion shop that will be offered by us on the site (e.g. My Fashion Platform), the service is only available for your personal use, and it is strictly prohibited for commercial use. You agree that no materials of any kind submitted through your account or otherwise posted, transmitted or shared by you through the Neighborhood will not violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material.
In addition, you agree not to use the service or the site to:
v Gather or collect email addresses or other contact information of other users from the service or the site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications.
v Impersonate a person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with a person or entity;
v Use the service or the site in any unlawful way or in any other way that could damage, disable, and overburden or impair the site;
v Upload, post, transmit, share, store, or otherwise make available any information other than those of a personal nature that (i) are of you or your friends (ii) are taken by you or by your friends, or (iii) are original designs created by you or your friends;
v Register for more than one user account, register for a user account on behalf of another individual, or register for a user account on behalf of any group or entity or business;
v Upload, post, transmit, share or otherwise, make available any unsolicited or unauthorised advertising, solicitations, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid schemes”, or any other form of solicitation.;
v Upload, post, transmit, share, store, or otherwise make available content that would constitute, encourage or provide instructions for a criminal offence, violate the rights of any party, or that would otherwise create liability or violate the local, state, national or international law;
v Upload, post, transmit, share, store, or otherwise make publicly available on the site any private information of any third party, including, without limitation, addresses, phone numbers, email addresses, social security numbers, and credit card numbers;
v Solicit personal information from anyone under the age of 13 or solicit passwords or personally identifying information for commercial or unlawful purposes;
v Upload, post, transmit, share or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality, of any computer software or hardware or telecommunications equipment;
v Intimidate, harass or bully another user (member or non-member);
v Use or attempt to use another’s account, service, or system without authorisation from the company, or create a false identity on the service or the site;
v Upload, post, transmit, share, store or otherwise make available content that, in the sole judgment of Fashion Platform, is objectionable or which restricts or inhibits any other person from using and enjoying the site or which may expose Fashion Platform or its users to any harm or liability of any type.
Without limiting any of the foregoing, you also agree to abide by our Neighbourhood Code of Conduct that provides further information regarding the authorised conduct of users on Fashion Platform.
10. Maximum Liability
Without limiting the proceeding clause, the aggregate liability of Fashion Platform under this Agreement (whether arising in negligence or otherwise) will not under any circumstances exceed an amount equal to (a) The Premier Membership fee payable at the time liability arises.
11. User Content Posted on the Site
You are solely responsible for the photos, profiles, designs, notes, text, information, advertisements, listings, and other content that you upload, publish or display on or through the Neighbourhood. You may not at any time post, transmit, or share user content in the Neighbourhood that you do not have permission to post. You understand that the company may, but are not obligation to, review the site and may delete or remove, without notice, any site content for any reason, or no reason, including without limitation user content that in the sole judgment of Fashion Platform violates this Agreement or the Fashion Platform Terms and Conditions of Use, or which may be deemed offensive, illegal, or that might violate the rights, harm, or threaten the safety of users or others. You are solely responsible at your sole cost and expense for creating back-ups and replacing any user content you post or store on the site which may, but not limited to, get lost, stolen or as an act of vandalism disappear.
When you post user content on the site, you give us authority to make copies thereof as we deem necessary in order to facilitate the posting and storage of the user content in the Neighborhood. Upon posting the user content to any part of the site, you irrevocably authorise us to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such user content for any purpose or in connection with the site or the promotion thereof. You may remove your user content from the site at anytime. If you choose to remove your user content, the license granted above will automatically expire, however you agree that the company may retain archived copies of your user content.
12. Copyright/Plagiarism Complaints
We put the utmost emphasis on intellectual property rights of others and we prohibit users from uploading, posting or otherwise transmitting on the Fashion Platform Neighborhood that violate another party’s intellectual property rights. When we receive notification of alleged copyright/ plagiarism infringement, as described in our copyright policy, we will promptly remove or disable access to the allegedly infringing material and terminate the accounts of repeat infringers as described herein in accordance with the Digital Millennium Copyright Act.

13. Repeat Infringers
Fashion Platform does not take infringement lightly, therefore in accordance with the Digital Millennium Copyright Act (DMCA) and any other applicable law, Fashion Platform will terminate Member’s accounts of those who are deemed to be repeating infringers. Fashion Platform may at it complete discretion limit access to the site and/or terminate the Membership of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement. You agree that if you have paid Membership and your account has been terminated you will not receive a refund, under any circumstances.
14. Third Party Websites and Content
The Neighborhood Contains (or you may be sent) links by third party sites as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, software and any other content or items belonging to or originating from third parties. Such third party sites, link, software or content are not monitored, investigated, or checked for accuracy, appropriateness or completeness by Fashion Platform, and Fashion Platform are not responsible for any third party accessed through the site or applications, software, links or content posted on the site, available through or installed from the site, including without limitation the content, accuracy, opinion, offensiveness, reliability, privacy policy practices or other policies of or contained in the third party sites, software, link or content. Permitting, linking or content does not imply acceptance or endorsement from Fashion Platform.
If you decide to leave the site and access the third party site you do so at your own risk and you should be aware that our Terms and Policies no longer govern. You are advised to review the applicable terms and policies including privacy and data gathering practices, of any sites to which you go to from our site.
15. Share Service
You acknowledge and agree that your use of the share service and all links, user content, software or content shared through the share service is subject to, and will fully comply with the user conduct rules detailed above and the other terms and conditions detailed in the Terms and Conditions of use.
16. Sharing information with Third Party Sites
Subject to the Terms and Conditions of Use, Third Party Sites that meet the requirements set forth below may place a Share Link (as detailed below), in the form approved by Fashion Platform on the user content pages of their website and other pages of their website, to facilitate use of the shared facility. A third party site that posts a share link on the website is referred to herein as a “Reciprocal Provider” and shall abide and be subject to the applicable sections of these Terms and Conditions of Use.
We will not be liable to the user or to any third party for losses when the agreement commences, for any indirect or consequential loss or damage, for any loss of data, profit, revenue or business, however caused – whether arising out of this agreement or otherwise.
In the event that the Shared info contains any icons or other graphics, trademarks or other company confidential material, the reciprocal provider has permission to use such images, materials or trademarks solely for the use of placing the link on their web pages. If the shared link is a text link it must contain the word Fashion Platform as part of the link. The right granted in this paragraph may be revoked at the Company’s sole discretion, and upon termination the reciprocal provider agrees to remove all such links from its web pages.
In order for a reciprocal provider to include a shared info link on its pages, the third party must not contain any web content that if shared or posted by a user would be a violation of the user conduct rules detailed above. Without limiting the forgoing, Reciprocal providers agrees not to post a share info on any web site that contains, and represents and warrants that such web site does not and will not contain, any content that is infringing, harmful, threatening, defamatory, abusive, inflammatory, harassing, vulgar, obscene, lewd, fraudulent, or invasive or privacy or publicly rights or that may expose Fashion Platform or any of it users to any harm or liability of any type. Upon including a Shared Info, Reciprocal Providers agrees to defend, indemnify and hold the company, it subsidiaries and affiliates, and each of it directors, officers, agents, contractors, partners, and employees harm and against any loss, liability, claim, demands, damages, costs, expenses, including reasonable attorney fees, arising out of connection with such share info, any links, content or other items or materials which may be shared or posted through such share info, or breach or alleged breach of the foregoing representations and warranties.
By including the shared info, Reciprocal Providers automatically agrees that it has the right to grant, to the Company irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use the share service in order to link to, use, copy, publish, stream, publicly perform, publicly display, reformat, translate, excerpt (in whole, or in part), summarise, and distribute the content, links and other material of any kind residing on any web pages on which Reciprocal Providers places the share info
You are solely responsible for your interactions with other Fashion Platform Users/ and or members. We reserve the right, but have no obligation, to monitor disputes between you and others.
18. Privacy
We care about the privacy of our users. Click here to view the Fashion Platform’s Privacy Policy. By using the Site or the Service, you are consenting to have your personal data processed in the company and may be shared with affiliate, or subsidiary companies.
19. Disclaimers
Fashion Platform is not responsible or liable in any way whatsoever for any User Content or Third Party, Software or Content, links posted on the Site or in connection with the Service, whether posted or caused by users of the Site, by Fashion Platform, by third parties or by any of the equipment or programming associated with or utilised in the Site or the Service. Although we provide rules for user conduct and postings, we do not control and are not responsible for what users post, transmit or share on the Site and are not responsible for any offensive, unlawful, obscene, inappropriate or otherwise objectionable content you may encounter on the Site or in connection with any User Content or Third Party applications, links, Software or Content. The Company is not responsible for the conduct, whether online or offline, of any user of the Site or Service.
Fashion Platform has the right to withdraw or modify the Site and/or Services in which case the site may be temporarily unavailable from time to time for maintenance or other reasons. Fashion Platform takes no responsibility for any error, omission, deletion, interruption, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, User communications. The Company is not responsible for any technical malfunction or other problems of any telephone network or service, computers systems, servers or providers, computer or mobile phone equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any site or combination thereof, including injury or damage to user’s or to any other person’s computer, mobile phone, or other hardware or software, related to or resulting from using or downloading materials in connection with the web and/or in connection with the Service. Under no circumstances will The Company be responsible for any loss or damage, including any loss or damage to any User Content or personal injury or death, resulting from anyone’s use of the Site or the Service, any User Content, Software or Content posted on or through the Site or the Service or transmitted to Users, or any interactions between users of the Site, whether online or offline. The Company may need to withdraw or modify aspects of the site, or the entirety of it, where we have legal or commercial reasons to do so. There may also be times when the Site is inaccessible as a result of technical difficulties, we will however try to overcome these difficulties within reasonable time where they are within our control. In these instances there will be no refund of the Premier Membership fees (neither will we have any other liability to you) for withdrawal, modification or unavailability of the Fashion Platform Service. We may require you to change you password or other information that aids in your access to Fashion Platform.
FASHION PLATFORM, THE SITE CONTENT ARE PROVIDED “AS-IS” AND THE COMPANY DISCLAIMS ANY AND ALL REPRESENTATIONS, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. THE COMPANY CANNOT GUARANTEE AND DOES NOT PROMISE ANY SPECIFIC RESULTS FROM THE USE OF THE SITE AND/OR THE SERVICE. THE COMPANY DOES NOT AGREE THAT SOFTWARE, CONTENT OR MATERIALS ON THE SITE, THE SERVICE OR ANY OTHER APPLICATIONS ARE ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE OR THAT THE SITE OR SERVICE ITS SERVERS, OR ANY PLATFORM APPLICATIONS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. IN NO EVENT WILL THE COMPANY OR ITS DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE TO YOU OR ANY THIRD PERSON FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING FOR ANY LOST PROFITS OR LOST DATA ARISING FROM YOUR USE OF THE SITE OR THE SERVICE,
THE COMPANY HAS NO LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO COMPANY FOR THE SERVICE DURING THE TERM OF MEMEBERSHIP, BUT IN NO CASE WILL THE COMPANY’S LIABILITY TO YOU EXCEED THE AMOUNT EQUAL TO THE PREMIER MEMBERSHIP.
NOTHING IN THIS AGREEMENT LIMITS FASHION PLATFORM’S LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM OUR NEGLIGENCE, OR ANY OTHER LIABILITY WHICH MAY NOT BY LAW BE EXCLUDED. ANY STATUTORY RIGHTS YOU MAY HAVE AS A CONSUMER REMAIN UNAFFECTED.
21. Termination
The company may terminate your membership, delete your profile and any content or information that you have posted on the Site and/or prohibit you from using or accessing the Service or the Site (or any portion, aspect or feature of the Service or the Site or any platform application) for any reason, or no reason, at any time in its sole discretion, with or without notice, including without limitation if it believes you are under 13.
22. Indemnity
You agree to indemnify and hold the Company, its subsidiaries and affiliates, and each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable legal fees, arising out of or in connection with any user content, any third party applications, software or content you post or share on or through the site (including without limitation through the share Service), your use of the Service or the Site, your conduct in connection with the Service or the Site or with other users of the Service or the Site or with other users of the Service of the Site, or any violation of this agreement or of any law or the rights of any third party.
23. Content
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the site or the Service provided by you to The Company are non-confidential and shall become the sole property of Fashion Platform. Fashion Platform shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these submissions for any purpose, commercial or otherwise, without acknowledgement or compensation to you.
24. Other
These terms of use constitute the entire agreement between you and the Fashion Platform regarding the use of the Service, superseding any prior agreements between you and Fashion Platform relating to the use of the Service. The failure of Fashion Platform to exercise or enforce any right or provision of these Terms and Conditions of Use shall not constitute a waiver of such right or provision in that or any other instance. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue to be enforced and in effect. If any provision of these Terms and Conditions of Use shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms of use and shall not affect the validity and enforceability of any remaining provisions.
